Jakarta, CNBC Indonesia – Law Number 20 of 2023 concerning State Civil Apparatus (UU ASN) was officially ratified by the President of the Republic of Indonesia Joko Widodo (Jokowi) on 31 October 2023.

The new regulations specifically regulate the arrangement of honorary staff or what are officially called non-ASN in government agencies.

The main regulatory points contained in this new law are strengthening supervision of the Merit System, determining the needs of civil servants and PPPK, welfare of civil servants and PPPK, structuring honorary staff, and digitizing ASN management, which includes the transformation of ASN management components.


In the closing provisions, in Article 66 of the Law replacing Law Number 5 of 2014, it is stipulated that the arrangement of non-ASN personnel must be completed by December 2024.

Apart from that, since this law came into effect on the date of ratification, it is also regulated that government agencies are prohibited from appointing non-ASN employees or other names other than ASN Employees.

“What is meant by arrangement includes verification, validation and appointment by an authorized institution,” as quoted from the explanation section of Article 66 of Law 20/2023, quoted on Saturday (4/11/2023).

Deputy for Human Resources for Apparatus at the Ministry of State Apparatus Empowerment and Bureaucratic Reform (PANRB) Alex Denni said that the complete technical arrangements for honorary personnel will be included in the Government Regulation on Management of State Civil Apparatus as a derivative rule from the latest ASN Law.

Alex said that the PP had actually been drafted at the same time as the discussion of the ASN Law in the DPR. The PP was prepared as a backup plan if the ASN Law reaches a dead end in the DPR. He said that at that time the PP had reached the 80% stage. However, the draft PP is still based on the old ASN Law.

Once the new ASN Law is passed by the DPR on October 3 2023, the PANRB Ministry must revise the regulations on the basis of the new ASN Law. The design progress has reached the 70% level and is targeted to be completed by the end of 2023.

“Hopefully it will be finished this year, if friends focus on finishing this, hopefully it will be finished,” said Alex Denni in a discussion at the DPR, Tuesday, (30/10/2023).

What is clear is that the latest ASN Law contains a mechanism to save the 2.3 million honorary workers in Indonesia. The fate of millions of honorary workers is actually hanging in the balance because the government previously decided that it would abolish the status of honorary workers by November 2023.

On various occasions, PANRB Minister Abdullah Azwar Anas has also emphasized that President Jokowi’s policy in resolving the honorary staff problem is that there will be no mass layoffs, no decrease in income, and no swelling of the government budget.

“President Jokowi’s instructions are clear, there should be no mass dismissals. That is the main and first principle,” said Anas.
