Jakarta, CNBC Indonesia – Polda Metro Jaya said that the Chairman of the Corruption Eradication Commission, Firli Bahuri, faces a maximum sentence of life imprisonment after being named a suspect in the extortion case of former Minister of Agriculture Syahrul Yasin Limpo. The maximum penalty can be imposed because the Regional Police charged Firli with Article 12 letter e, Article 11 or Article 12 B of the Corruption Eradication Law (UU Tipikor).
“In paragraph 2 (Article 12 B) it is stated that the punishment for civil servants or state administrators as referred to in paragraph one is life imprisonment or imprisonment for a minimum of 4 years and a maximum of 20 years, and a fine of at least IDR 200 million and a maximum of IDR 1 billion,” said the Director of Criminal Investigation at Polda Metro Jaya, Ade Safri Simanjuntak in a press conference quoted from detik.com, Wednesday (22/11/2023).
The following is a complete quote from Article 12 B of Law Number 20 of 2001 concerning Amendments to Law Number 31 of 1999 concerning the Eradication of Corruption Crimes.
Article 12 B
(1) Every gratuity to a civil servant or state administrator is considered a bribe, if it is related to his or her position and is contrary to his or her obligations or duties, with the following provisions:
a. whose value is IDR 10,000,000.00 (ten million rupiah) or more, proof that the gratification is not a bribe is carried out by the recipient of the gratification;
b. whose value is less than IDR 10,000,000.00 (ten million rupiah), proof that the gratuity was a bribe was carried out by the public prosecutor.
(2) The punishment for civil servants or state administrators as intended in paragraph (1) is life imprisonment or imprisonment for a minimum of 4 (four) years and a maximum of 20 (twenty) years, and a fine of at least Rp. 200,000. 000.00 (two hundred million rupiah) and a maximum of IDR 1,000,000,000.00 (one billion rupiah).
Polda Metro Jaya officially announced that it had named Firli as a suspect at a press conference held on Wednesday night (22/11/2023). Ade Safri said the decision was taken in a case held on the same day.
In this case, the Regional Police have examined 91 witnesses, including examining Firli twice. The Regional Police have also searched two of Firli’s houses in Bekasi and Kertanegara, South Jakarta.
“A case has been carried out with the results of the discovery of sufficient evidence to name FB as chairman of the Indonesian Corruption Eradication Committee as a suspect,” said Ade.
In the near future, the Regional Police will also summon Firli to be questioned as a suspect. Firli has on several previous occasions denied blackmailing SYL. “I, Firli Bahuri, declare that there have never been any extortion, gratification or bribery activities,” said Firli.
